International Color & Style Institute is part of Impact Styling.

Article 1 - General
Ms. M. Bilderbeek acting under the name International Color & Style Institute, part of Impact Styling is registered with the Chamber of Commerce under number 75896230 and is located at Energieweg 8 (1271ED) in Huizen, hereinafter: Impact Styling. Impact Styling is the provider of the International Color& Style Institute website which User can use. By using the International Color& Style Institute website, User agrees to these terms of use. User must accept these terms of use before using the International Color& Style Institute web site. If User does not agree to these terms of use, International Color& Style Institute requests User not to further use this International Color& Style Institute web site. International Color& Style Institute encourages anyone using the International Color& Style Institute Web site to review the terms and conditions periodically for changes. If one or more provisions of these terms and conditions are partially or entirely void or destroyed, the remaining provisions of these terms and conditions will remain in force and the void / destroyed provision(s) will be replaced by a provision with the same scope as the original provision. Uncertainties about the content, interpretation or situations that are not regulated in these terms and conditions should be assessed and interpreted in the spirit of these terms and conditions. By using the International Color& Style Institute website, User agrees that International Color& Style Institute communicates about the services by means of messaging (including electronic communication). Where reference is made to the website, this also includes the online portal.

Article 2 - Privacy, data processing and security
International Color& Style Institute is careful with the (personal) data of the user. Personal data will only be processed in the context of carrying out the services of International Color& Style Institute. International Color& Style Institute will not process personal data for any other purpose and never longer than necessary. Article 3 - Use of the International Color& Style Institute website
International Color& Style Institute makes every effort to make the International Color& Style Institute website available to Users. All services are performed on the basis of an obligation of effort. User can access the International Color& Style Institute website after User has created an account. User is at all times responsible for all data and information that he places or allows to be placed on her account and/or the International Color& Style Institute website. If user suspects that the information provided by him is incorrect or incomplete, user will inform International Color& Style Institute immediately and provide the correct information. User must keep his own data up to date and can change his data in his own account. User, once an account and profile is created, can view the purchased exclusive content of the respective training, course, workshop, webinar or module and, if agreed upon, receive personalized guidance.

Article 4 - Obligations when using the International Color& Style Institute website.
User has at all times an independent responsibility for the use of the International Color& Style Institute website. User is obliged to abide by the following regulations while using the International Color& Style Institute website. User must refrain from using the International Color& Style Institute website: To use manual or automated software, equipment or other processes to index or scrape data used within the International Color& Style Institute website on the Internet; in a way that involves illegal activities or activities contrary to morality or public order; to copy (parts of) the International Color& Style Institute website, to otherwise harm the interests of International Color& Style Institute. In case of (possible) criminal acts, International Color& Style Institute is entitled to report it and to hand over the information provided by User to the competent authorities, as well as to perform all acts required of it as part of the investigation. International Color& Style Institute is entitled to deny User access to the International Color& Style Institute website and/or terminate the use of the International Color& Style Institute website. In addition to the obligations under the law, any damage caused by incompetence or failure to act in accordance with the above points is at the risk and expense of the user. Users are responsible for the proper security of the (mobile) device on which they use the International Color& Style Institute website, as well as the security and confidentiality of his / her own login details. Each User must create an account for the purpose of accessing and using the website. The account can be registered with an email address and a password, unless otherwise specified. The User is obliged to provide correct and complete information during account registration and to keep the account up-to-date at all times. The User is personally responsible for his or her login information and should not provide this login information to third parties. If a User suspects that the login information has been lost, stolen or possible unauthorized use of the account, User should contact International Color& Style Institute immediately. User is personally liable for all activities performed through their own account, unless User can prove that they have not been negligent (failure to report the unauthorized use or loss of login information).

Article 5 - Access to the website.
International Color& Style Institute only offers the use of the International Color& Style Institute website. International Color& Style Institute never has any responsibility over and/or influence on the execution of the offered services by the affiliated network operator. All information and numbers displayed on the International Color& Style Institute website are subject to spelling or typographical errors. Users shall ensure that International Color& Style Institute provides International Color& Style Institute with all information which International Color& Style Institute indicates is necessary or which users can reasonably understand is necessary to access and/or use the International Color& Style Institute website in a timely manner. International Color& Style Institute is not liable for damages of any kind caused by International Color& Style Institute is based on incorrect and / or incomplete information provided by the User, unless such inaccuracy or incompleteness was known to International Color& Style Institute.

Article 6 - Availability International Color& Style Institute website
International Color& Style Institute does not guarantee that the services will always meet the predetermined expectations. International Color& Style Institute strives to make every effort to provide the International Color& Style Institute website and access to the International Color& Style Institute website uninterrupted to the extent possible, but does not guarantee the full availability of the International Color& Style Institute website at all times. International Color& Style Institute is entitled if and insofar as, in its opinion, there is a risk to the flawless operation of the International Color& Style Institute website and to suspend the use of the International Color& Style Institute website. International Color& Style Institute is further entitled to take any measures it deems reasonably necessary to ensure the effective operation of the International Color& Style Institute website.

Article 7 - Notice and takedown
If and insofar as there is an infringement of rights of International Color& Style Institute or third parties and/or unlawful acts by User, International Color& Style Institute is entitled to immediately shut down that part of the International Color& Style Institute website or exclude User from using it. International Color& Style Institute will remove any infringing/harmful information immediately. Under no circumstances will International Color& Style Institute be liable for damages of any kind suffered as a result of the (temporary) closure of the service and / or removal or transfer of data.

Article 8 - Faults and repairs
If and insofar as the User suffers a malfunction and/or the website is not properly installed or not working, the User can make use of remote assistance. User can contact us via the contact information on the website of International Color& Style Institute or via info[@]internationalcolorstyleinstitute.com.

Article 9 - Payment
The right to use the International Color& Style Institute website is subject to a fee payable by User per separate training, course, workshop or module. The content thereof and the conditions applicable to it will be made available to User before entering into the agreement with International Color& Style Institute. If user does not meet her (payment) obligations arising from the agreement or these conditions, International Color& Style Institute has the right to terminate the agreement and / or suspend or terminate the use of the International Color& Style Institute website.

Article 10 - Limitation of liability
User indemnifies International Color& Style Institute from the moment User first uses the International Color& Style Institutewebsite for all damages incurred, except in case of intent or gross negligence on the part of International Color& Style Institute. International Color& Style Institute is not liable or bound for the proper performance of the agreement by the Grid Operator. International Color& Style Institute is not liable for any damage that is or may be the result of (incomplete and / or incorrect) information on the International Color& Style Institute website or those of linked websites or websites. If the performance of services leads to liability of International Color& Style Institute towards User, that liability is limited to the costs charged by International Color& Style Institute in connection with the agreement with respect to direct damage. Direct damage is defined as reasonable costs incurred to limit or prevent direct damage, the determination of the cause of damage, the direct damage, the liability and the manner of recovery. Under no circumstances is International Color& Style Institute is responsible for errors and/or irregularities in the functionality of the International Color& Style Institute website and is not liable for malfunctions or unavailability of the International Color& Style Institute website for any reason whatsoever, or the loss and/or corruption of User's data and information. International Color& Style Institute is not responsible for the correct and complete transmission of the content of and email sent by / on behalf of International Color& Style Institute, nor for its timely receipt. International Color& Style Institute is not liable for the fact that User has not, not correctly and/or not timely received the account information. Never is International Color& Style Institute liable if User has not kept his login and/or account information in a safe place. All claims by the user due to shortcomings on the part of International Color& Style Institute will expire if not reported to International Color& Style Institute within one year. Any claim for damages against International Color& Style Institute should always be reported in writing, but at the latest within one year after User was aware or could reasonably be aware of the facts on which he bases his claims. After this period such a claim will lapse.

Article 11 - Force Majeure
International Color& Style Institute is not liable when, due to a force majeure situation, it cannot fulfill its obligations, nor can it be held to fulfill any obligation if it is hindered to do so as a result of a circumstance that is not due to his fault, and by virtue of law, a legal act or generally accepted practice. Force majeure includes in any case, but is not limited to what is understood in this respect in the law and jurisprudence, (i) improper performance of obligations by suppliers or subcontractors, (ii) defectiveness of goods, equipment, software or materials of third parties, (iii) government measures, (iv) power failure, (v) failure of internet, data network and telecommunication facilities (for example due to: cybercrime and hacking), (vi) fire, (vii) natural disasters, (viii) war and terrorist attacks, (ix) general transport problems, (x) strikes in the company of International Color& Style Institute and (xi) other situations which in the opinion of International Color& Style Institute are beyond its control that temporarily or permanently prevent the fulfillment of its obligations. International Color& Style Institute has the right to invoke force majeure if the circumstance preventing (further) performance occurs after International Color& Style Institute should have fulfilled its commitment.

Article 12 - Agreement with grid operator.
International Color& Style Institute only provides an International Color& Style Institute website for User to use and does not affect the arrangements and agreement between a User and the grid operator. The grid operator is at all times responsible for the execution of the service. User is responsible for providing correct and complete information to the grid operator. Any consequences of the inaccuracy and/or incompleteness thereof will be at the expense and risk of the User.

Article 13 - Intellectual property rights
The User is expressly prohibited from infringing on the intellectual property rights of International Color& Style Institute, as well as the good name of International Color& Style Institute. All intellectual property rights and copyrights of the International Color& Style Institute website, including the graphic designs, ideas and the like relating to the International Color& Style Institute website belong exclusively to International Color& Style Institute and are expressly not transferred to User. User has a non-exclusive right to use the International Color& Style Institute website personally and for private use. The software of the International Color& Style Institute website remains at all times the property of International Color& Style Institute. The software works only in conjunction with a made fee/payment for the training, course or module to which User will have access, and in accordance with the purpose for which the website. The User is prohibited from making illegible, changing or removing any indication related to the intellectual property rights of International Color& Style Institute or any legally required (trademark) signs, or indications such as the CE mark from the International Color& Style Institute website.

Article 14 - General (sales) conditions
The use of the International Color& Style Institute website is also subject to the general (sales) conditions of International Color& Style Institute. In case matters are not explicitly covered in these terms of use, reference is made to the (content of) the general (sales) conditions of International Color& Style Institute.

Article 15 - Complaints
If User is not satisfied with the services offered through the International Color& Style Institute website, User is obliged to report these complaints as soon as possible, but no later than 14 days after the reason that led to the complaint. Complaints can be reported via info@internationalcolorstyleinstitute.com with the subject "Complaint". The complaint must be sufficiently substantiated and/or explained by the User for International Color& Style Institute to be able to handle the complaint and declare it valid. International Color& Style Institute will respond to the complaint as soon as possible, but no later than 14 days after receipt of the complaint. Failures and / or problems resulting from improper use are at the risk and expense of the user.

Article 16 - Changes
International Color& Style Institute has the right to unilaterally modify these terms and conditions. User will be informed as soon as possible. In any case, user can view the amended conditions on the International Color& Style Institute website.

Article 17 - Dispute resolution
The legal relationship between International Color& Style Institute and user is governed by Dutch law. If any provision of these terms proves to be void or non-binding, Parties remain bound by the remaining provisions. Parties will replace the void and/or non-binding provision(s) by a binding provision whose scope is as much as possible the same as the provision(s) to be replaced, within the framework of these terms and conditions. All disputes between International Color& Style Institute and User shall be settled by the competent court of the District Court Midden-Nederland, location Utrecht, unless provisions of mandatory law lead to the jurisdiction of another court.
